ST PETERSBURG WAS THE FIRST OF THE RUSSIAN REGIONS TO SIGN COOPERATION AGREEMENT WITH TURKMENISTAN

Agreement between the Governments of Turkmenistan and St Petersburg of the Russian Federation on economic, scientific, technical and cultural cooperation

The Government of Turkmenistan and the Government of St Petersburg of the Russian Federation hereinafter referred to as the Sides,

Considering the economic, scientific, technical and cultural cooperation established between Turkmenistan and the Russian Federation one of the efficient means of furthering and strengthening the friendship between the two peoples,

With a view to making more efficient use of the economic, scientific, technical and cultural potential of the Sides,

Guided by the principles and provisions of the Friendship and Cooperation Treaty between Turkmenistan and the Russian Federation of April 23, 2002, the Agreement between the Government of Turkmenistan and the Government of the Russian Federation on cooperation in the field of culture, education and science of May 18, 1995, and the Joint Declaration between Turkmenistan and the Russian Federation on cooperation in the field of science, culture and education of May 19, 2000,

Have agreed as follows:

Article 1

The Sides develop the economic, scientific, technical and cultural cooperation on the basis of equality, goodwill and mutual benefit.

Article 2

The Sides cooperate in accordance with generally accepted norms of international law on the basis of the bilateral agreements and treaties and domestic legislatures of Turkmenistan and the Russian Federation.

Article 3

The Sides facilitate the expansion of the mutually beneficial cooperation between business structures and organizations regardless of the form of ownership.

Volumes, nomenclature and prices for the delivered goods and services as well as terms and procedures of mutual payments are stipulated in agreements and contracts concluded between business structures, liable for their implementation under contracts' obligations, in accordance with the legislature of Turkmenistan and the Russian Federation.

The Sides promote the implementation of joint investment projects and programs of mutual interest.

The Sides facilitate the use by business structures of the Sides of seaports' infrastructure in the cities of Turkmenbashi and St Petersburg.

The Sides facilitate meeting the needs of the Sides in modern state-of-the-art equipment, best quality goods and services.

With the view of establishing and speeding up direct contacts between Turkmenistan and St Petersburg the Sides promote the trade, including through opening of trade representations.

Article 4

In the field of the scientific and technical cooperation the Sides promote by all means joint scientific researches in various directions and forms, including researches in the form of expeditions and exchanges of materials of mutual interest in accordance with the national legislatures of Turkmenistan and the Russian Federation.

The Sides assist scientific organizations of Turkmenistan and St Petersburg in engaging scientists in publication of researches both of specific and general nature.

Article 5

In the field of culture the Sides encourage the contacts between cultural organizations of Turkmenistan and St Petersburg and facilitate the exchange of visits between cultural groups and certain people of culture.

The Sides provide full support for the activity of the Association of Cultural Relations between Turkmenistan and Russia and the Association of Cultural Relations between Turkmenistan and St Petersburg.

The Sides facilitate the development of business relations between organizations working in the field of tourism, excursions and arranging expositions and fairs.

The Sides promote the cooperation between sport organizations, associations, federations, teams and managers of Turkmenistan and St Petersburg and facilitate the establishment of contacts in various fields of physical culture and sport.

Article 6

The Sides cooperate in the establishment and development of cooperation between educational and scientific organizations and in the expansion of enrollment of citizens of Turkmenistan for education and scientific traineeship in the establishments of higher professional education of St Petersburg, including in the framework of development of the country researches and cooperation in preparation of specialists in this field in accordance with the national legislatures of the Sides.

The Sides pay specific attention to the education of student orientalists in the Oriental faculty of St Petersburg's State University with a view to preparing highly professional research specialists on history of Turkmenistan, Turkmenistan-Russia relations and the system of Oriental civilizations.

Article 7

This agreement is valid within 5 years and takes effect on the day of its signing.

On the Sides' mutual consent this agreement can be amended in the form of additional protocols as integral part of this agreement.

Each Side can terminate this agreement by written note sent to the other Side. This agreement ceases to be effective after 6 months from the day of such notification.

Article 8

The termination of this agreement does not affect programs and projects in the process of development and will not affect the agreements signed on its basis, if not agreed otherwise by the Sides.

Any differences in the interpretation and application of the provisions of this agreement should be resolved through consultations and negotiations between the Sides.

Done in Ashgabat, on February 18, 2004, in two originals in Turkmen and Russian with both texts having equal force.
