Aiming at further democratization of state and social life, ensuring the law and solid order in our independent, permanently neutral state of Turkmenistan, proceeding from the proposal on amendments and additions to the Constitution (Main Law) of Turkmenistan prepared, discussed and submitted by the Mejlis of Turkmenistan for consideration by Khalk Maslakhaty of Turkmenistan, Khalk Maslakhaty of Turkmenistan makes the following amendments and additions to the Constitution of Turkmenistan in accordance with article 48 of the Constitution of Turkmenistan:
1. The sixth phrase of the first paragraph of Article 46 is revised as follows: "Governors of districts and towns, archins of towns and villages, which are the administrative centers of districts."
2. The first part of Article 50 is revised as follows: "Khalk Maslakhaty is convened by the Chairman of Khalk Maslakhaty or the President of Turkmenistan when a need arises, but not less than once a year, based on proposals of the Chairman of Khalk Maslakhaty, the Turkmen president, the Mejlis or one third of the fixed number of members of Khalk Maslakhaty. If the Chairman of Khalk Maslakhaty of Turkmenistan or the president of Turkmenistan for one reason or another cannot perform their duties, Khalk Maslakhaty is convened on the basis of the State Security Council's resolution. The Chairman of Khalk Maslakhaty, the President of Turkmenistan, the Mejlis, the Cabinet of Ministers, public organizations comprising the Galkynysh National Movement of Turkmenistan, as well as not less than one fourth of the fixed number of members of Khalk Maslakhaty, possess the right to submit proposals for consideration of Khalk Maslakhaty."
3. Article 51 is revised as follows: "Khalk Maslakhaty is headed by the Chairman of Khalk Maslakhaty. A citizen of Turkmenistan, who was born in Turkmenistan, who is not younger than 40 and not older than 70, who knows the state language and has resided permanently in Turkmenistan in the last 15 years, who works in the leading bodies of state authority and government, who has gained high prestige, who is a member of Khalk Maslakhaty, and who is elected in an open vote by two-thirds of the votes of the fixed number of members of Khalk Maslakhaty, can be the Chairman of Khalk Maslakhaty. The Chairman of Khalk Maslakhaty is elected for the period of five years and is accountable to Khalk Maslakhaty."
4. The second part of the Article 60 is revised as follows: "If the President for one reason or another cannot perform his duties, a Deputy prime minister is appointed acting Turkmen president by a resolution of the State Security Council until a new president is elected. In this case, a presidential election should be held not later than 60 days from the day when his powers were passed to the acting president of Turkmenistan."
